These Terms of Service constitute the agreement between Matthew Lawrence Tardy ("the Merchant") and any visitor to or customer of the Store ("the Customer"). The use of the Store, or the placing of any Order, shall constitute the Customer's acceptance of these Terms in full.

§ 1 — General Provisions

(a) In these Terms, "Merchant," "we," "us," and "our" mean Matthew Lawrence Tardy. (b) "Customer," "you," and "your" mean any person visiting the Store or placing an Order. (c) "Store" means vqugfp-zd.myshopify.com and all products offered through it. (d) "Order" means a completed purchase transaction between the Merchant and a Customer.

§ 2 — Eligibility

(a) The Customer represents that they are at least 18 years of age, or acting with the permission of a parent or legal guardian. (b) The Customer represents that they are legally capable of entering into a binding agreement under U.S. law.

§ 3 — Account Security

(a) Where an account is created, the Customer shall be solely responsible for the confidentiality of the credentials and for all activity conducted under the account. § 4 — Order Formation

(a) A submitted Order shall constitute the Customer's offer to purchase at the prices and terms displayed at checkout. (b) Acceptance by the Merchant shall occur upon dispatch of the Order confirmation email. (c) The Merchant may decline an Order prior to acceptance for reasons including: (i) unavailability of the item; (ii) a material error in price or description; (iii) suspected fraud; (iv) breach of these Terms. (d) A paid Order that is subsequently cancelled by the Merchant shall be refunded in full to the original method of payment.

§ 5 — Pricing

(a) All prices are stated in U.S. dollars. (b) Prices may change without notice; the price displayed at checkout is the price applicable to that Order. (c) Where a product is displayed under a manifestly incorrect price, the Merchant reserves the right to cancel the affected Order rather than fulfill at the erroneous price, with a full refund.

§ 6 — Payment

(a) Payment shall be due at checkout through the methods offered by the Merchant. (b) By submitting payment information, the Customer confirms authorization to use the payment method.

§ 7 — Shipping, Returns, and Refunds

(a) Shipping is governed by the Merchant's Shipping Policy. (b) Returns and refunds are governed by the Merchant's Return and Refund Policy. (c) Both are incorporated into these Terms by reference and shall apply to every Order.

§ 8 — Product Descriptions

(a) The Merchant shall describe each product with reasonable accuracy. (b) Minor variations in color, texture, finish, or dimension — particularly from screen calibration or from the nature of sports and technical materials — shall not constitute a defect.

§ 9 — Intellectual Property

(a) All content on the Store — including text, photography, illustrations, graphic design, video, source code, layout, and the "Matthew Lawrence Tardy" name and associated marks — is the property of the Merchant or used under license. (b) U.S. copyright and trademark law applies. (c) As a visitor, the Customer may: (i) browse the Store; (ii) share links to product pages; (iii) save pages for personal reference. (d) The Customer shall not, without prior written consent of the Merchant: (i) reproduce, republish, or commercially exploit content; (ii) use the Merchant's imagery or brand in a third-party business; (iii) scrape, mirror, or systematically extract material from the Store; (iv) modify or redistribute any portion of the Store.

§ 10 — Acceptable Use

(a) The Customer shall not use the Store for any unlawful or fraudulent purpose. (b) The Customer shall not compromise the security or availability of the Store. (c) The Customer shall not transmit malware, viruses, or other harmful code. (d) The Customer shall not use bots, scrapers, or other automated tools without written permission. (e) The Customer shall not impersonate any person or misrepresent affiliation. (f) Breach of this § 10 may result in immediate suspension of access.

§ 11 — Disclaimer of Warranties

(a) The Store and the products offered thereon are provided on an "as is" and "as available" basis. (b) To the fullest extent permitted by U.S. law, the Merchant disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. (c) The Customer's statutory consumer rights are unaffected by this § 11.

§ 12 — Limitation of Liability

(a) The Merchant's aggregate liability for any direct claim arising from an Order shall not exceed the amount paid by the Customer for the product giving rise to the claim. (b) The Merchant shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

§ 13 — Termination

(a) The Merchant may suspend or terminate the Customer's access to the Store, with or without notice, for any breach of these Terms.

§ 14 — Governing Law and Jurisdiction

(a) These Terms are governed by U.S. federal law and by the laws of the state in which the Merchant's business is registered, without regard to conflict-of-law principles. (b) Any legal proceeding shall be brought exclusively in the appropriate state or federal courts of that jurisdiction.

§ 15 — Amendments

(a) The Merchant may amend these Terms at any time. (b) Amendments shall take effect immediately upon publication. (c) Continued use of the Store after amendment shall constitute acceptance of the revised Terms.
